Privacy & POPIA Policy

1. Who we are

This policy is issued by JW van Zyl Inc, an incorporated legal practice in Cape Town, South Africa ("the firm", "we"). For the purposes of the Protection of Personal Information Act, 2013 (POPIA), the firm is the responsible party.

2. Information we collect

Legal matters may involve confidential and special personal information; we handle all such information under legal professional privilege and strict confidentiality.

4. Lawful basis

We process personal information on the bases recognised by POPIA: your consent; the conclusion or performance of a mandate; compliance with legal obligations; and our legitimate professional interests. Where we rely on consent, you may withdraw it at any time.

5. Sharing

We do not sell personal information. We share it only as necessary — for example with independent advocates we brief, our associated entities where you have engaged them, service providers (such as our website host and form provider), and authorities or regulators where required by law. All such parties are subject to confidentiality obligations.

6. Cross-border & security

Some service providers may process information outside South Africa; where they do, we apply section 72 of POPIA. As required by section 19, we take reasonable technical and organisational measures (including HTTPS and access controls) to protect personal information, and will notify you and the Information Regulator of any material compromise as the law requires.

7. Retention

We retain information for as long as necessary for the matter and to meet legal, professional, and tax obligations, after which it is securely destroyed or de-identified.

8. Your rights

Subject to POPIA, you may request access to your information, request correction or deletion, object to processing, and lodge a complaint with the regulator. Contact info@jwvanzylinc.com to exercise these rights.
